Fokus utama penelitian ini adalah mengevaluasi relevansi Pasal 2 ayat (4) Piagam PBB terhadap serangan siber. Penulis menyimpulkan bahwa kedaulatan digital merupakan manifestasi modern dari kedaulatan teritorial yang memerlukan traktat internasional spesifik.
1. Pendahuluan
Hukum internasional merupakan pilar utama yang menjaga ketertiban dunia. Secara klasik, hukum ini didefinisikan sebagai prinsip yang mengikat negara-negara dalam hubungan internasional. Namun, di abad ke-21, munculnya ruang siber (cyberspace) telah mengaburkan batasan fisik tradisional. Persoalan utama yang muncul adalah bagaimana instrumen hukum yang diciptakan pasca-Perang Dunia II tetap relevan dalam menghadapi ancaman nirwujud seperti spionase siber dan sabotase digital.
2. Sumber-Sumber Hukum Internasional
Berdasarkan Pasal 38 ayat (1) Statuta Mahkamah Internasional (ICJ), sumber hukum utama meliputi:
- Perjanjian Internasional: Produk hukum tertulis yang disepakati oleh subjek hukum internasional.
- Kebiasaan Internasional: Praktik umum yang dilakukan terus menerus dan diakui sebagai kewajiban hukum (Opinio Juris).
- Prinsip Hukum Umum: Norma yang diakui secara universal oleh sistem hukum nasional di seluruh dunia.

4. Pembahasan: Tantangan Penegakan Hukum
Salah satu hambatan terbesar dalam hukum internasional siber adalah masalah Atribusi. Secara teknis, sangat sulit untuk membuktikan secara yuriditas bahwa sebuah serangan siber diperintahkan langsung oleh suatu pemerintahan negara. Tanpa atribut yang jelas, mekanisme bela diri (self-defense) sesuai Pasal 51 Piagam PBB sulit untuk dijustifikasi secara hukum internasional.
5. Kesimpulan
Hukum internasional harus bersifat dinamis. Meskipun prinsip dasar kedaulatan tetap sakral, interpretasi terhadap “penggunaan kekerasan” harus diperluas mencakup serangan siber yang merusak sistem vital negara. Diperlukan kerja sama multilateral melalui konvensi global untuk mengatur perilaku negara di ruang digital guna mencegah anarki siber.
